MATRIXGOLD PRIMARY TRAINING COURSE
SERVICE AGREEMENT
This Service Agreement (“Agreement”) applies to participation in the Evotech Pacific MatrixGold Primary Training Course supplied by Evotech Pacific Systems Pty Ltd (“Evotech Pacific”, “we”, “us” or “our”).
By purchasing, enrolling in, accessing or using the MatrixGold Primary Training Course (“Course”), the participant (“Student”, “you” or “your”) acknowledges that they have read, understood and agreed to the following terms.
1. COURSE ACCESS
Upon successful payment and enrolment, the Student will receive access to the MatrixGold Primary Training Course for a fixed period of twelve (12) months.
The 12-month access period begins from the date Course access is first activated or made available to the Student.
At the conclusion of the 12-month period, access to the Course, including all videos, tutorials, downloads, training materials and other Course content, will automatically expire.
It is the Student’s responsibility to complete the Course within the allocated 12-month access period.
2. NO EXTENSIONS
The Course access period is strictly limited to twelve (12) months.
Evotech Pacific Systems does not provide extensions to Course access.
Students are responsible for managing their own time and ensuring that they complete the training, tutorials and exercises before their access expiry date.
Personal circumstances, workload, holidays, illness, changes in employment, failure to access the Course regularly or failure to complete the Course within the allocated period will not normally result in additional access being granted.
Nothing in this clause excludes any rights or remedies that cannot lawfully be excluded under applicable Australian law.
3. REFUNDS
Due to the digital nature of the Course and the immediate availability of training materials following enrolment, Course fees are non-refundable once access has been provided, including where the Student:
- changes their mind;
- decides not to continue with the Course;
- does not use or fully utilise their Course access;
- fails to complete the Course within the 12-month access period;
- experiences a change in personal, business or employment circumstances; or
- decides that the Course is no longer required.
This refund policy does not limit or exclude any rights the Student may have under the Australian Consumer Law or any other rights that cannot legally be excluded.
4. COURSE LEVEL AND SUITABILITY
The MatrixGold Primary Training Course has been specifically developed as a foundation-level course for students who are new to MatrixGold or who wish to establish a stronger understanding of its fundamental tools, workflows and jewellery design principles.
No previous MatrixGold experience is required.
The Course intentionally begins with fundamental concepts and progresses through the essential skills required to establish a solid foundation upon which more advanced MatrixGold skills can later be developed.
Students who already have previous MatrixGold, jewellery CAD, Rhino or similar CAD experience should carefully consider the Course description and advertised content before purchasing to determine whether the Primary Course is appropriate for their current skill level.
A Student deciding after purchase or gaining access that the Course is too basic, elementary or similar to knowledge they already possess does not entitle the Student to a refund, credit, transfer or Course substitution, except where required by law.
5. PRIMARY AND SECONDARY COURSE ENROLMENTS
The MatrixGold Primary and MatrixGold Secondary Training Courses are separate training products with separate enrolments and Course fees.
Purchase of the Primary Course does not include access to the Secondary Course.
If, after purchasing or commencing the Primary Course, a Student decides that the Secondary Course would have been more appropriate for their existing skill level, the Student cannot transfer their Primary Course enrolment to the Secondary Course or simply pay the difference between the two Course fees.
Access to the Secondary Course requires a separate purchase at the applicable Secondary Course price.
Any unused portion of the Primary Course fee cannot be credited towards the Secondary Course.
Students who are uncertain which Course is most appropriate for their level of experience are encouraged to contact Evotech Pacific Systems before purchasing so that we can assist them in selecting the most appropriate training option.
Nothing in this clause limits any rights or remedies that cannot lawfully be excluded under Australian Consumer Law.
6. COURSE CONTENT
The Primary Course is designed to establish a strong working foundation in MatrixGold through structured tuition, practical jewellery design projects and demonstrations of core tools, techniques and workflows.
The purpose of the Course is not simply to teach Students how to reproduce individual jewellery designs. Projects are used to demonstrate techniques and workflows that can be adapted and applied to future jewellery design work.
The Course does not guarantee that the Student will achieve any particular level of competency, commercial success, employment outcome or financial result.
7. SOFTWARE AND EQUIPMENT
Unless specifically stated otherwise, the Course fee does not include:
- MatrixGold software;
- Rhinoceros software;
- computer hardware;
- internet access;
- third-party software;
- manufacturing equipment; or
- any other products or services required to undertake the training.
The Student is responsible for ensuring that they have access to suitable software, hardware and internet connectivity.
Evotech Pacific is not responsible for Course access or performance issues caused by the Student’s computer, internet connection, software installation, operating system, network, firewall or other third-party technology.
8. SOFTWARE VERSIONS AND UPDATES
MatrixGold and Rhinoceros are third-party software products that may be updated or modified by their respective developers.
As a result, the appearance, location or operation of certain tools demonstrated in the Course may change over time.
Evotech Pacific does not guarantee that every Course video will exactly match future versions of MatrixGold, Rhinoceros or associated software.
Where reasonably practical, Course content may be updated or supplemented at Evotech Pacific’s discretion.
9. INTELLECTUAL PROPERTY
All Course materials supplied by Evotech Pacific, including video tutorials, written instructions, exercises, course notes, demonstrations, graphics, CAD models, downloadable files, teaching methods and supporting materials remain the intellectual property of Evotech Pacific Systems Pty Ltd and/or their respective copyright owners.
Purchasing the Course provides the Student with a personal, limited, non-transferable licence to use the Course materials for their own education.
Course materials must not be reproduced, recorded, copied, republished, uploaded, distributed, sold, sublicensed, shared or made available to another person without prior written permission from Evotech Pacific Systems.
10. ACCOUNT SHARING
Course access is provided solely for the individual Student enrolled in the Course.
Login details must not be shared with another person.
Businesses wishing to provide Course access to multiple employees or users must purchase the appropriate number of Course enrolments unless otherwise agreed in writing by Evotech Pacific Systems.
Evotech Pacific reserves the right to suspend or terminate Course access where it reasonably believes an account is being shared, copied or used in breach of this Agreement.
No refund will be provided where access is terminated due to a breach of this Agreement, subject to any rights that cannot legally be excluded.
11. TRAINING SUPPORT
Any support supplied as part of the Course is intended to assist Students with understanding the Course material.
Support does not include unlimited private tuition, jewellery design services, completion of Course projects on behalf of the Student, computer repair, network support or support for unrelated third-party software unless specifically agreed otherwise.
Evotech Pacific reserves the right to determine the reasonable scope and method of Course support.
12. STUDENT RESPONSIBILITY
The Student remains responsible for completing the Course within the access period, regularly accessing the Course, practising the techniques demonstrated, maintaining their own files and backups, and independently checking their designs before manufacture.
The Student is also responsible for checking dimensions, tolerances, stone sizes, manufacturing requirements and the suitability of any design for its intended production process.
13. MANUFACTURING AND DESIGN RESULTS
Jewellery CAD involves numerous variables including manufacturing processes, materials, tolerances, casting, printing, machining, stone setting and finishing.
Evotech Pacific cannot guarantee that a model created by a Student will manufacture successfully simply because a similar technique was demonstrated during the Course.
The Student is responsible for assessing the suitability of their designs before manufacture.
14. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Evotech Pacific Systems Pty Ltd will not be liable for indirect, incidental, special or consequential loss arising from participation in the Course, including loss of profits, loss of business, loss of production, loss of data or manufacturing losses.
Where liability cannot lawfully be excluded, Evotech Pacific’s liability will be limited to the extent permitted by applicable law.
Nothing in this Agreement excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law that cannot legally be excluded, restricted or modified.
15. COURSE AVAILABILITY
Evotech Pacific will take reasonable steps to maintain access to the Course platform during the Student’s enrolment period.
Temporary interruptions may occur because of maintenance, software updates, internet outages, third-party platform issues or circumstances outside Evotech Pacific’s reasonable control.
Temporary interruptions do not automatically extend the Student’s 12-month enrolment period.
Where a substantial interruption caused directly by Evotech Pacific prevents Course access for an unreasonable period, Evotech Pacific will determine an appropriate remedy having regard to the circumstances and applicable law.
16. TERMINATION FOR MISUSE
Evotech Pacific may suspend or terminate Course access where the Student materially breaches this Agreement, including through unauthorised account sharing, copying or distributing Course materials, recording or republishing Course videos, misuse of intellectual property, unlawful activity or conduct intended to compromise the Course platform.
Termination resulting from a material breach does not entitle the Student to a refund, subject to applicable law.
17. CHANGES TO COURSE CONTENT
Evotech Pacific may update, improve, replace or reorganise Course content where reasonably necessary to reflect software developments, improved teaching methods or changes to the MatrixGold platform.
Such changes do not constitute a failure to provide the Course purchased by the Student.
18. GOVERNING LAW
This Agreement is governed by the laws of Australia and the applicable laws of the State or Territory having jurisdiction over the transaction.
19. ACCEPTANCE
By purchasing, enrolling in and/or accessing the MatrixGold Primary Training Course, the Student confirms that they:
- understand that the Primary Course is a foundation-level MatrixGold training program;
- have reviewed the Course description and consider the Course appropriate for their needs;
- understand that Course access is limited to 12 months;
- understand that Course access will expire after that period;
- understand that Evotech Pacific does not ordinarily provide extensions;
- understand that Course fees are non-refundable once Course access has been supplied, except where required by law;
- understand that deciding the Course is too basic for their existing skill level does not provide an entitlement to a refund;
- understand that the Primary and Secondary Courses are separate products;
- understand that a Primary Course enrolment cannot be transferred or credited towards the Secondary Course and that the Student cannot upgrade simply by paying the difference;
- agree not to share or distribute Course materials;
- accept responsibility for completing the Course within the allocated period; and
- agree to the terms contained in this Service Agreement.
